What is a Statutory Demand?
A statutory demand is a formal demand made against a company for payment of a debt. Statutory demands are governed by the Companies Act 1993 and can be a powerful debt recovery tool where a company owes money that is due and payable.
Once a valid statutory demand has been served, the debtor company generally has 15 working days to pay the debt, enter into an arrangement to secure or compound the debt to the creditor's reasonable satisfaction, or apply to the High Court to have the demand set aside.
Failure to appropriately respond to a statutory demand can have serious consequences for the debtor company.
